Terms & Conditions
BOOKING AND PAYMENT SCHEDULE: Because hotels often fill up quickly and airlines’ best fares sell out immediately, it is recommended that you make your reservations several months in advance. All trips require an initial deposit of 50% per person*, which can be paid by bank transfer or check. For bookings and to make your initial deposit, please call us at +1 (415) 871-0531. If you are outside of the U.S., please dial our office in Brazil at +55 (21) 99595-6057. Upon receipt of your deposit, a complete tour contract will be forwarded that outlines all terms and conditions pertaining to the booking. The signed contract must be returned to Charming Destinations within 3 calendar days upon receipt, and final payment is due 90 days prior to departure. If you fail to make the payment on of before the due date, your booking will be cancelled and your deposit refunded to you, less a $500 per person service fee. If your reservation is made within 90 days of departure, the entire cost of the trip must be paid at the time of your trip reservation in order to secure confirmation. Following full payment, final travel documents will be provided, including a detailed trip itinerary, pre-departure information with suggested clothing list, suggested reading list, and any additional information you will need to prepare for your trip. WE DO NOT SELL AIRLINE TICKETS.
*Some high-end Hotels and Lodges in Brazil require full pre-payment or have 50% non-refundable deposit policies to secure the reservation. The tour contract will disclose all such policies to our clients.
CANCELLATIONS: All cancellations must be received in writing. Within 24 hours of your cancellation request, you will receive written confirmation of receipt from Charming Destinations. Please contact our office if you do not receive confirmation of receipt within 24 hours after your cancellation request has been made. Up to 90 days prior to the scheduled tour departure, all deposits are refundable, less a $500 per person service fee. Any trips that are canceled within 90 days of departure, forfeit 100% of the full tour price.
To avoid penalties that apply to the next cancellation period, should the last date on the cancellation period fall on a weekend or US holiday, please submit your cancellation request no later than the last business day of that deadline period. For example, if your trip cancellation is within the 91 days cancellation period, but the 91th day is a Saturday, your cancellation must be submitted on the 92nd day to avoid the additional penalties of the 90 days or fewer cancellation period.
Hotels, lodges and transfer schedules for cruises, private helicopter/planes/boats/cars departures, extensions, and certain Special Events are subject to strict cancellation penalties. Any penalties and/or fees imposed by our suppliers as a result of a cancellation will be added to the penalties outlined above. Higher penalties may also be applied if your trip was scheduled to take place during Christmas, New Year, Carnival, Easter, Brazilian holidays periods, and weekends. INCLUDED IN OUR PACKAGES: All accommodations as noted in the listed itinerary, with a detailed trip itinerary being provided to clients upon receipt of full payments; meals as specified; arrival and departure transportation transfers; fully guided sightseeing as noted in the itinerary (including park and entrance fees); selected beverages at selected hotels, lodges, and cruises; the handling of two pieces of baggage per person for international flights (other conditions/restrictions may apply for domestic routes); hotel taxes; cruise taxes; Charming Destination account service before your travel and access to a 24 hour emergency line to a Destination Specialist, should any questions or concerns arise during your travels.
NOT INCLUDED IN PACKAGE PRICES: The optional Passenger Travel Protection Plan; international and domestic airfares; fuel surcharges for international flights; costs associated with obtaining passports or entry visas; airport departure taxes; excess baggage charges; gratuities to the restaurant staff, porters, local guides, drivers, and ship crews; meals and beverages other than specified in the itinerary; sightseeing not included in the itinerary; personal expenses such as laundry, communication charges and optional activities.
GRATUITIES: Gratuities for restaurant staff, porters, local guides, ship crews and drivers are not included in the program price, and are at the traveler’s discretion and should be based on the level of satisfaction with the service received.
ITINERARIES: While every effort will be made to operate itineraries as planned, modifications may occur after the final itinerary has been issued. Due to unforeseen circumstances or circumstances that may be beyond Charming Destinations’ control, accommodations and arranged tours are subject to change at any time. Charming Destinations reserves the right to withdraw a tour package or any part of it, to make such alterations to the itinerary or the package inclusions as it deems necessary, and to pass on to clients any expenditures or losses caused by delays or events beyond its control.
SPECIAL REQUESTS: Please advise Charming Destinations at the time of your booking of any specific requests such as adjacent or connecting rooms, bedding requests, smoking rooms and/or special dietary needs. While we will make every effort to secure your special requests, it cannot be guaranteed in advance of travel.
PRICING: Quoted program prices include planning, handling and operational charges and are based on current rates of exchange, tariffs and taxes. Charming Destinations is under no obligation to give a breakdown of costs involving any of its tours. Charming Destinations reserves the right to increase program prices to cover increased costs, tariffs, taxes and V.A.T. received after prices are published. Please note that the prices for trips in certain areas of Brazil are seasonal. Prices rise significantly during the periods of Christmas, New Year, Carnival, Easter, Brazilian holidays, as well as weekends, and are subject to strict cancellation policies by hotels, lodges, and tour operators.
Charming Destinations is not responsible for omissions in the itinerary, printing errors, including on its websites, and reserves the right to make corrections as required, including adjustment of incorrectly displayed prices.
EARLY HOTEL CHECK-IN: For programs where immediate check-in has not been included in the package price, Charming Destinations has requested that all hotels provide the service when possible, but it cannot be guaranteed. Most hotels allow check-in to take place during the mid-afternoon, however, your bags can be held at the front desk until your room is available. Should you wish to have a guaranteed room ready for your immediate check-in upon arrival at all of your destinations, it can be arranged for an additional charge. Please ask your Destination Specialist for complete details and pricing.
EARLY ARRIVAL: To ensure you have time to relax after your initial travels to Brazil, Charming Destinations recommends that you arrive a day or two before the start of your reserved tour. Due to possible flight disruptions and cancellations caused by inclement weather, it is highly recommended that clients depart early from the U.S. and Canada during the winter months. We have negotiated favorable rates at many hotels for those guests interested in early arrival; please ask your Destination Specialist for details at time of your booking.
PHYSICAL ACTIVITY: Trip members have the responsibility to select a trip appropriate to their abilities and interests. Some active elements have been incorporated into select itineraries. To enjoy the trip as intended, a minimum level of fitness is required. Charming Destinations will require advance notice if any participant has any condition or disability that could create a hazard to him or herself. Please inform your Destination Specialist of such conditions at the time of your booking and all efforts will be made to adjust your desired tour as needed. If such conditions are not advised of before your departure, Charming Destinations reserves the right to remove from the trip, at the participant’s own expense, anyone whose condition is such that it could create a hazard to him or herself or others. PASSENGER TRAVEL PROTECTION PLAN: Charming Destinations strongly recommends that all clients purchase trip cancellation insurance. Because some insurance coverage must be purchased within a limited time frame after you have made your trip deposit, we recommend you review your insurance options prior to booking your trip. Our preferred travel insurance company is CSA Travel Protection. MINORS: Charming Destinations does not have a specific minimum age requirement*, but some hotels or activities contained within an itinerary may have age restrictions. Please advise your Destination Specialist of any questions or concerns relating to age requirements and they will be able to provide you with complete details based off your package selection.
Parents traveling with a child under 18 must present the child’s birth certificate and photo ID (passport for foreign visitors) upon check-in. If only one parent or legal guardian is traveling with the child, that parent or legal guardian must also present a notarized consent of travel signed by both parents. Visitors who plan to travel with children should consult with a Brazilian consulate office prior to travel for further guidance.
*The minimum age on Iberostar Grand Amazon cruise is 15 years.
PASSPORTS AND VISAS: Valid passports are required for all international destinations. A copy of your valid passport must be submitted to Charming Destinations in order to confirm air reservations. Charming Destinations cannot be held responsible should you be denied entry to a country due to non-compliance with passport or visa requirements. Check with the appropriate consulate or embassy for the latest visa requirements. Currently, US passport holders are required to have a visa to enter Brazil as tourists. Please note that non-U.S. passport holders are responsible for obtaining the required documentation applicable for entry. Passports must be valid for six (6) months following the date you enter to Brazil and should also have sufficient blank pages for visas and immigrations stamps.
AIR TRANSPORTATION: WE DO NOT SELL AIRLINE TICKETS. International and domestic airfares are not included in Charming Destinations’ program pricing. Charming Destinations has partnerships and special agreements with airline ticket consolidators that can provide quotes from any point of departure. Please ask your Charming Destinations tour consultant about special Business and First Class fares offered by our partners.
CLAIMS AND REFUNDS: Refunds will not be made for any missed services, except for verifiable extenuating circumstances. For verifiable claims to be considered, they must be received in writing within 30 days of the termination of the program and be accompanied by supporting documentation and/or a statement from the local destination company verifying the claim. Charming Destinations will not accept any liability for any claims that are not received in writing within 30 days of the termination of your travel program. Any adjustment considered will be based on the actual price of the services involved and not on a per diem basis. Adjustments will not be made for unused activities, sightseeing trips, or meals. Please see our limits on Charming Destinations’ liability clause below.
LIMITS OF LIABILITY: Charming Destinations does not own or operate any entity that provides goods or services for your trip. Charming Destinations is a third party vendor that purchases transportation (by aircraft, coach, train, vessel or otherwise), hotel and other lodging accommodations, restaurant, ground handling and other services from various independent suppliers. All such persons and entities are independent contractors. As a result Charming Destinations is not liable for any negligent or willful act of any such person or entity or of any third person.
In addition and without limitation, Charming Destinations is not responsible for any injury, financial or physical loss, death, inconvenience, delay or damage to personal property in connection with the provision of any goods or services whether resulting from but not limited to acts of God or force majeure, illness, disease, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of aircraft or other means of transportation or for failure of any transportation mechanism to arrive or depart on time. There are many inherent risks in adventure travel of the type involved here, which can lead to illness, injury, or even death. These risks are increased by the fact that these trips take place in remote locations, far from medical facilities. All passengers assume all such risks associated with participating in this trip.
TRAVEL ADVISORIES AND WARNINGS: It is the responsibility of the traveler to become informed about the most current travel advisories and warnings by referring to the U. S. State Department’s travel website at travel.state.gov or by phone at 1-888 407 4747 (USA). In the event of an active State Department Travel Warning against travel to the specific destination location(s) of the trip, should the traveler still choose to travel, notwithstanding any travel advisory or warning, the traveler assumes all risk of personal injury, death or property damage that may arise out of the events like those advised or warned against. Should the traveler decide to cancel their trip due to such warnings or advisories, all cancellation penalties listed under terms and conditions are still in effect.
ARBITRATION AGREEMENT: Any controversy or claim arising out of or relating to these Terms and Conditions, to Charming Destinations’ responsibility clause, to the itinerary, to any information relating in any way to the trip, to the trip itself, or to any products or services related to the trip, shall be settled solely and exclusively by binding arbitration in San Francisco Bay Area, California, in accordance with the Commercial Arbitration Rules of the American Arbitration Association, except that (a) in lieu of a personal appearance at arbitration, the arbitration may be conducted by telephonic means, (b) arbitration is the exclusive forum for dispute resolution (no court actions), and (c) except as otherwise provided by statute, each party shall bear its own costs and expenses and an equal share of the arbitrator and administrative fees.
ANY PAYMENT TO CHARMING DESTINATIONS CONSTITUTES YOUR ACCEPTANCE OF THE TERMS AND CONDITIONS SET OUT HEREIN AND IN MORE SPECIFIC PRE-DEPARTURE PASSENGER DOCUMENTATION, INCLUDING THE PERSONAL TOUR CONTRACT.
